Terms of Service

1. Acceptance of Terms

By accessing or using APEX ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. APEX is operated by Backend Branding LLC.

2. Subscription & Billing

APEX is offered on three paid tiers:

• Starter — $497/month. Up to 3 ad accounts. Core platform features.
• Growth — $997/month. Up to 10 ad accounts. Includes competitor intelligence, SMS automation, and Shopify sync.
• Agency — $1,997/month. Unlimited ad accounts. Includes white-label dashboard and client sub-accounts.

All plans include a 14-day free trial. No credit card is required during the trial period. After 14 days, your selected plan will be billed monthly.

No refunds. All payments are final. You may cancel your subscription at any time; you will retain access until the end of the current billing period.

If payment fails, your account will be suspended until a valid payment method is provided. We reserve the right to change pricing with 30 days' notice to your registered email.

3. Acceptable Use

You agree to use APEX only for lawful purposes. You may not use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit malicious code, spam, or unauthorized advertising
• Attempt to gain unauthorized access to any system or network
• Resell or sublicense access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate this policy without notice or refund.

4. Ad Platform Compliance

APEX connects to Meta, Google, and TikTok advertising platforms via their official APIs. You are solely responsible for ensuring your ad campaigns, creatives, and landing pages comply with the policies of each platform. Backend Branding LLC is not liable for account restrictions, bans, or policy violations that result from your use of those platforms.

APEX does not control ad platform review decisions. Platform enforcement actions are outside our control and are not grounds for refunds or service credits.

5. Data & Privacy

We collect and process data as described in our Privacy Policy. By using APEX, you grant us permission to access your connected ad accounts, store campaign data, and use aggregated, anonymized data to improve the Service.

You retain ownership of your data. We do not sell your personal information to third parties. You may request deletion of your data by contacting us at support@backendbranding.com.

6. Termination

You may cancel your account at any time through the billing page. We reserve the right to terminate or suspend your account for violation of these Terms, non-payment, or any reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKEND BRANDING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
